Zoko's Terms and Conditions

These are the terms that govern your use of Zoko. Zoko is operated by Bourbon Science Inc., a Delaware corporation trading as Zoko, and provides a platform for businesses to sell, market, and support customers on WhatsApp and other messaging channels.

The set is deliberately split into separate documents so that you can find what you need without reading everything. Use the list on the left to go straight to any of them.

Where to start

If you only read one, read the Terms of Service. It is the master agreement, and every other document is incorporated into it by reference. The others exist to keep that agreement readable, and to let us update a specific area without re-papering the whole contract.

Terms of Service: the master agreement. Accounts and security, messaging compliance, fees, tax and billing, selling through the platform, termination, intellectual property, confidentiality, liability, disputes, and the WhatsApp special terms.
Acceptable Use Policy: what is not permitted on the platform, including child safety, harassment, privacy, spam and fraud, synthetic media, link abuse, restricted businesses, plus how we enforce it and how to report abuse.
AI Terms: how the AI features work contractually. Inputs and outputs, model training and your opt-out, mandatory human oversight, responsibility for what an AI says to your customers, adversarial use, and spend controls.
Privacy Policy: how we handle personal data, the rights you and your customers have, international transfers, our GDPR compliance, and our ISO 27001 information security programme.
Refund Policy: when fees are and are not refundable, prepaid balances, why service credits are not refunds, and how to request one.
Data Processing Addendum: the GDPR Article 28 terms that apply when we process personal data on your behalf, including the Standard Contractual Clauses.
Sub-processors: every vendor we use to deliver the Services, with its purpose and location.
Service Level Agreement: our uptime commitment, what is excluded from it, and the service credits available if we fall short.
Cookies Statement: the cookies our website sets and how to control them.
Data Act Addendum: switching and data portability rights for customers established in the European Union.

How the documents fit together

The Terms of Service prevail over every other document, with two exceptions. The Data Processing Addendum prevails on the processing of personal data, and the Data Act Addendum prevails on switching and portability for customers established in the European Union.

Each subject lives in one place only, so there is no duplication to reconcile. Content and conduct rules are in the Acceptable Use Policy. AI is in the AI Terms. Availability is in the Service Level Agreement. Personal data is in the Privacy Policy where Zoko is the controller, and in the Data Processing Addendum where Zoko is a processor acting on your instructions.

One position runs consistently across the set: Meta, Shopify, AI providers and payment processors bill you directly, hold your data under their own terms, and are excluded from our uptime commitment and our liability. Nothing you pay them passes through Zoko.

Security and compliance

Zoko is ISO 27001 v2022 compliant and GDPR compliant. Our current status, our control framework, our security and data protection policies, and documents such as our records of processing activities are published in our Trust Center at https://zoko.trust.site/.
